1. Parrots and similar birds eggs, are prohibited, a big no-no, and finally taboo from being sold on Ovabid.com. Parrots and other similar birds can be sold, but only using Delta Shipping.
Doves and Pigeons are permitted.
2. When posting a want ad, please use classified ads selection so that people do not bid on a want item. Also, please include in the title of the ad Wanted:(I want a convertable!), or if it is an actual classified ad, put Classifed:(corndogs for sale). This will help differentiate classifieds from want ads from auctions.
3. We only render services to folks (that's people) interested in selling and buying through Internet auction listings. We do not have control over the products that are listed in the auction site and cannot guarantee the legitimacy and condition of any listing. We are not accountable for the actions users take, prior to, for the duration of, and/or subsequent to the auction, typographical errors, misprints, shortfall of merchandise/money, damage or malfunction of equipment, due to your visit to www.ovabid.com. Use of this site is taken at your own risk.
4. You must hold Ovabid harmless from all claims evolving from any disagreements or disputes between a buyer, seller, or any other user of Ovabid. Ovabid serves as a go-between to make possible dealings between buyers and sellers. Ovabid is not accountable for anything enclosed in any auction listings or feedback. In no way may Ovabid be held legally responsible for inappropriate use.
5. Ovabid will not be held accountable for any loss or damages caused by errors by the system or the Internet. Ovabid is not liable for bids unrecorded due to complications generated by any technological difficulties.
6. Users must never use Ovabid for any deceitful or criminal purpose. The selling of mature content or materials, unlawful items, weapons, etc is strictly prohibited. Any listing of such items will result in me being as angry as a chihuauhua in a cashmere jumpsuit and your account being suspended from using Ovabid.com AND Law Enforcement being notified.
7. Only those at least 18 years or older and legally able to enter into a binding contract can register and/or use Ovabid. When registering, you are required to user your legal/real first and last name, real mailing address, and real phone number, and a real/valid email address. If any information is found to be bogus or the user is found to be unable to form a legal and binding contract, the user account will be revoked/suspended.
8. Please do not use any user information for any reason other than to complete an auction. Any other use is strictly prohibited. This includes blasting/posting user information anywhere and spamming. Offenders will be suspended from Ovabid.com.
9. Sellers pay applicable fees for successful ending of an auction, including fees for options chosen when listing the item (bold or highlighted listings, featured, etc.)
10. No goosing your auctions. This means do not artificially bid on your own items, or have someone bid on an item with no intention of really following through with the deal. Violators will have their account suspended if caught.
11. Ovabid, LLC. will absolutely not guarantee that sellers will fulfill the sale of an item, or that winning bidders will pay for an auction. Buy and sell at your own risk!
12. Sellers should contact winning bidder after the auction end to arrange payment & delivery. Changes subsequent to the end of an auction are not allowed.
13. Item descriptions are required to consist of information appropriate to the item listed in the auction. Inappropriately listed auctions will be removed or re-categorized with or without notification. If it is found that auctions are listed incorrectly on purpose, your account can be suspended. Ovabid can remove any auction that is not accurate.
14. When buying an item, upon receiving notification that you are the highest bidder contact the seller to arrange the exchange of payment and item. Bidders are bound to any bids they make. Winning bidders are obligated to complete the transaction. Failure to complete the transaction will result in suspension of your account. Ask all need to know questions before placing a bid.
15. It is the burden of the user to learn and know shipping rules, regulations and policies set forth by USPS, the NPIP, and any other shipping agency, or governing jurisdiction with shipping of animals and/or products. Ovabid, LLC will not be at fault for any failure to concur with these regulations. You also acknowledge that Ovabid, LLC. will not be held accountable in the circumstance of prosecution for failure to comply state/stated regulations and policies. 16. Feedback is forever (just like diamonds). Be careful what you say. Try to resolve issues before posting negative feedback.
17. Ovabid, LLC. reserves the right to change user agreements and policies at any time without prior warning. Use of the site after such changes constitutes agreement to policies.
18. Users can only sell to people located in the same country.
19. When shipping birds use approved shipping containers approved for that type of bird and do not overfill them. Shipping containers must be in good condition for shipping birds so they will arrive at their destination safely.
20. Past due invoices will be charged a late fee of $1. If the account remains past due, the account will be suspended until payment is received.
21. It is the responsibility of the seller to collect any appropriate tax sales taxes. Remember, the government is your friend.
22. It is HIGHLY illegal to take a bird from the wild. Sellers MUST send all birds & eggs...dead or alive with any required paperwork. Don't sell something you aren't supposed to if you don't have a permit or license to do it! Know your state and federal laws reguarding what you are selling. Any violators will have their accounts suspended, and you might be tarred & feathered.
